TERMS OF AGREEMENT
BETWEEN PROPANE BUYER and SELLER
Period of Contract:
This agreement will become effective between the Buyer and Seller upon initial propane delivery, if tank is owned by Buyer; or upon installation of a Supplier owned propane tank on Buyer’s property. The agreement will be operational for the full initial contract term selected in your enrollment form.
Termination:
Termination of this agreement can be done: (A.) After the initial period chosen for service or any subsequent yearly period with not less than 60 days prior written notice to the other party or (B) By the Buyer or Supplier after the failure of the other party to fulfill or conform to any of the terms or conditions hereof that is provided in writing or (C) By Seller pursuant to paragraph 10 hereof. (The contract goes through 6) At this time, your membership with Freedom Energy Group will also be terminated. We will provide any unused membership fees to you based on the remaining months in the 12 month membership cycle.
Default:
If Buyer defaults under this contract for any reason, the Buyer agrees to pay Seller as liquidated damages, not as a penalty, any remedy available by law or in equity, the total monthly sum deemed fair by the Supplier/Buyer for each calendar month remaining in said contract.
Removal:
Buyer shall pay for the cost of removal of leased equipment including transit and rigging to Seller’s plant if lease is terminated before or at the end of lease. Following Fees Apply: $135 pick up fee / 0.99 per gallon of LP returned.
